Dana Pellegrino is a trusted counselor to some of the world’s most iconic brands. Her practice style is straightforward and approachable. Dana’s goal with each client is to make protecting and enforcing intellectual property non-intimidating and to evaluate the business risks in a manner that best positions the client to move forward.
Dana practices in a broad range of industries, including fashion, retail, consumer-branded products, tech, fine art, and publishing. In each of these industries, she has extensive knowledge of consumer behavior and trends. Dana’s experience as in-house product counsel deepens her commitment to understanding each client’s product and business goals.
Dana helps businesses apply for trademark and copyright registrations in the U.S. and internationally. She brings creative strategies to worldwide enforcement both through the online and brick-and-mortar marketplaces. She has extensive experience with complex branding issues, including limited edition collaborations, rebranding, and fair use of third party intellectual property. She also litigates trademark, copyright, and trade dress cases in federal court, the Trademark Trial and Appeal Board (TTAB), and bodies for the Uniform Domain-Name Dispute-Resolution Policy (UDRP).
Dana’s transactional experience extends to not only drafting and negotiating trademark and copyright licenses, assignments, coexistence and settlement agreements, but also, a wide variety of service and commercial agreements, including MSAs/PSAs and SOWs, independent contractor and work-for-hire agreements, and software and data licensing agreements.
Dana is also a regulatory advisor for emerging consumer rights and digital media marketing issues, including advertising guidelines and disclosures, publicity rights, "green advertising," influencer and sponsorship agreements, and FTC, FCC, and NAD enforcement. She has wide-ranging experience filing DMCA claims across many platforms, including social media, e-commerce, and domain hosting.
Dana is currently on secondment as in-house product counsel at one of the world’s largest tech companies. She works on the most cutting-edge VR/AR products and focuses on AI/ML research, data privacy, software licensing, and the changing regulatory landscape.
Outside of her practice, Dana likes upskilling in her client’s’ industries, including in fashion (using her sewing machine to DIY clothing), jewelry (welding and design), and home décor (sourcing and rehabbing antiques). She is a third-generation New Yorker and is proud to be part of the local community.
