Irfan Malani practices in the area of intellectual property law with a focus on litigation. He has extensive experience handling and litigating intellectual property disputes, including patent, trademark, and trade secrets.

Mr. Malani has litigated cases across various technologies and industries, including telecommunications, medical devices, and cybersecurity. He is adept at assisting clients through all stages of litigation, from pre-trial through trial. He has represented clients in various federal district courts and agencies, such as the Trademark Trial & Appeal Board, and has significant experience in the most active patent litigation jurisdictions, including the U.S. District Court for the Eastern District of Texas.

In his litigation practice, Mr. Malani provides comprehensive legal analysis, collaborates with fact witnesses and experts, manages discovery, and prepares motions and pretrial documents. He is also experienced in enforcing and defending intellectual property rights through pre-litigation efforts, including drafting cease and desist letters.

Mr. Malani graduated cum laude from the University of Illinois at Urbana-Champaign College of Law, where he was notes editor of the Elder Law Journal. His undergraduate degree is also from the University of Illinois at Urbana-Champaign, a B.S., Chemistry and B.A.&Sc., Economics. He has a working proficiency in Hindi.

Representative Matters

  • Represented Somerset Therapeutics LLC in settling Hatch-Waxman litigation related to 0.7% olopatadine ophthalmic solution in the United States, a generic version of PATADAY® Once-Daily, permitting entry into the market prior to patent expiry.

  • Arthrodesis Technology LLC v. Wright Medical Technology, Inc., Case No. 1:21-cv-00011-MN (D.Del. 2021-23). Counsel for Wright Medical in a patent infringement suit related to an ankle arthrodesis nail used for ankle fusion. Resolved case in advance of summary judgment on terms client found favorable.

  • Aided in representing Restor3d and Patrick Eckels in a trade secrets case brought by a major competitor, Paragon 28. The case concerns 3D-printed metal medical implants and is being hotly contested in New Jersey and North Carolina.

  • Assisted in representing Fortune 100 retailer in multiple patent litigation matters related to Bluetooth technology in the Western District of Texas that respectively resulted in a voluntary dismissal of the plaintiffs’ claims, and a resolution through settlement.

  • Helped settle a patent infringement action involving multi-configurable hand trucks.

  • SARN SD3 LLC v. Czechoslovak Group, a.s. – Aided in prosecuting claims for breach of contract concerning a call option agreement resulting in settlement of some claims and granting of summary judgment in others. On appeal to the Supreme Court of the State of Delaware.

  • Assisted in defending a semiconductor company in the largest patent infringement case ever filed against the company, in terms of potential exposure.

  • Part of a team defending Rapid7 in a seven-patent infringement lawsuit that is targeting most of its products, including willful infringement allegations.

  • Assisted in representing Trend Micro in a patent infringement matter involving network and computer security products. Taasera Licensing LLC v. Trend Micro Inc., Case No. 2:21-cv-00441-JRG.
