Representative Matters
Represented a developer in securing the replacement of over 20,000 defective exterior stone facade panels on a 50-story New York high-rise condominium; the construction manager will, at its own cost and at no cost to the client, procure and install an entirely new building facade, and the client will receive the majority of the remaining proceeds of a performance bond provided by the initial facade contractor. The transaction also included negotiations with the project lenders, the New York City Department of Buildings, and the New York City School Construction Authority.
Obtained a rare reversal by the New York City Office of Administrative Trials and Hearings (OATH) on behalf of Gilston Electrical Contracting LLC in connection with a decision by the New York City Comptroller's Office denying Gilston's claim for additional costs for changed work on a power generation project at an upstate reservoir. The contracting agency initially rejected the claim, finding that the changed specifications were "performance specifications" only and that Gilston was responsible for all costs to meet those requirements. Gilston contended that the changed work included "design specifications," and the OATH panel agreed, awarding Gilston the full value of its claim.
