Representative Matters

  • Secured the dismissal of a putative class action brought against Lenox Corporation, an American tableware company, under the California Invasion of Privacy Act (CIPA). The case is significant for all companies that operate public-facing websites utilizing chat features, which have lately become targets for class action lawsuits alleging that such features violate the wiretap provisions of CIPA. In its holding, the Northern District of California rejected plaintiffs’ theories and adopted the arguments presented by the Duane Morris team that: 1) Lenox cannot violate CIPA by recording chats in which it is a participant (known as the party exception); and 2) plaintiffs’ conclusory allegations that Lenox permitted an unidentified third party to eavesdrop on the chats were “not entitled to the presumption of truth” without specific details.
