Tarsha A. Phillibert practices in the area of litigation with a focus on white-collar defense. Tarsha leads complex cross-border investigations and monitorships, helping companies of varying sizes navigate government and internal investigations, address compliance gaps and transform their organizational culture.  

Tarsha helps clients investigate and understand the scope of allegations related to financial crimes, including money laundering, bribery, corruption, and sanctions violations, as well as issues concerning racial and gender discrimination. She represents corporate entities, boards, nonprofit organizations and individuals enmeshed in government investigations, both criminal and regulatory.

In her role as monitor, Tarsha assists government agencies in ensuring that companies guilty of misconduct have completely addressed the issues and have the necessary measures to prevent future occurrences.

Tarsha partners with general counsel and chief compliance officers to design effective, sustainable risk-based compliance programs to prevent and detect misconduct and that organizations can adapt to new technologies and business models.

Prior to joining Duane Morris,  Tarsha was a trial attorney for the U.S. Department of Justice, Criminal Division, Fraud Section, where she investigated and prosecuted complex white-collar cases across the country and internationally, including violations of the Foreign Corrupt Practices Act (FCPA), money laundering, healthcare fraud, and the Bank Secrecy Act. Prior to her position with the Department of Justice, Tarsha served as Special Assistant United States Attorney in the Eastern District of New York and was a partner in the white-collar criminal defense, government enforcement and investigations practice of her previous law firm.

Representative Matters

  • Led highly sensitive investigations on behalf of special committees of the Board of charitable organizations into allegations involving the leadership of the organization.

  • Led global FCPA compliance risk assessments for multi-national companies, advising chief compliance officers on revamping the companies’ global anticorruption compliance program.

  • Co-led the investigation of the monitorship of Credit Suisse AG following the bank’s $715 million settlement with the New York Department of Financial Services. This is part of a broader $2.6 billion settlement that involves the U.S. Department of Justice and federal regulators.

  • Led the compliance team for the court-ordered Monitor of 27 high volume gun retailers following their settlement with New York federal and state regulators to resolve civil and criminal liability.

  • Represented individuals in connection with domestic and international criminal and regulatory investigations into the setting of foreign exchange rates.

  • Representing executives of a global financial institution in connection with sanctions investigations by banking regulators, the Department of Justice, the New York Attorney General’s Office, and the New York County District Attorney’s Office.
