Duane Morris represents both landowners and governmental and quasi-governmental entities in eminent domain and land valuation matters across the country.
For landowners, Duane Morris understands the importance and value of property to our clients’ businesses and personal affairs. To protect our clients’ property values and interests, Duane Morris attorneys negotiate with governmental entities to attempt to minimize the impact of public projects on our clients’ property. Duane Morris is also experienced in negotiating and litigating to seek the highest compensation for our clients when the government condemns property and to obtain reduced tax assessments when the government attempts to raise the property’s assessed value. To identify and advocate for the best valuation outcome for both condemnation awards and tax appeals, Duane Morris often collaborates with expert appraisers, land planners, engineers and other professionals. In addition to condemnation and tax appeals, Duane Morris also represents landowners in inverse condemnation proceedings to require the government to pay fair compensation when property is rendered worthless by regulation or is otherwise taken without compensation.
On the governmental side, Duane Morris frequently represents governmental and quasi-governmental entities, such as public utilities, to assist in their acquisition of property for public projects. We understand the complexities of acquiring property for large projects that involve multiple landowners and that span multiple municipalities in a state, as well as the concerns that arise in acquiring property for smaller, individual projects. When the government needs property for projects, we negotiate with landowners to attempt to amicably acquire the necessary property interests. If the landowners are unwilling to sell, Duane Morris attorneys are well versed in litigating eminent domain proceedings.
