David J. Wolfsohn is a nationally renowned intellectual property trial lawyer who has tried dozens of cases to verdict and argued numerous appeals. A Fellow of the American College of Trial Lawyers, he has been described by clients in Chambers USA (where he is listed in Band I) as a "phenomenal litigator" with a "wonderful combination of technical knowledge and ability to connect with a jury and clients” and "very smart and aggressive in the courtroom." In 2020, Mr. Wolfsohn was named Philadelphia Lawyer of the Year in trademark litigation by Best Lawyers in America, and in 2012, he received the same award for copyright litigation. Among the jury verdicts he has obtained is a defense verdict for the H.J. Heinz Company over the idea for the Dip and Squeeze and the largest indirect-profits copyright award in The Graham Company v. USI MidAtlantic.

Representative Matters

  • Elias v. ICE (S.D. Fla.). Obtained summary judgment on behalf of hotel chains, affirmed by 11th Circuit, in $1.5 billion case under the Digital Millennium Copyright Act regarding dissemination of photographs on the internet.

  • Colony Grill Development v. Colony Grill, Inc. (D.Conn.). Defeated two motions for preliminary injunction in trademark and trade secrets case prevailing in four separate appeals to the Second Circuit.

  • Moon Express v. Intuitive Machines (D. Del.). Obtained jury verdict (affirmed by Third Circuit) on behalf of Intuitive Machines in a lawsuit over IP ownership and work performed on moon landing software and robotic space shuttle.

  • Wawrzynski v. H.J. Heinz Co., et al. (W.D. Pa.). Obtained defense verdict in dispute over ownership of ideas for Heinz's Dip and Squeeze ketchup package.

  • The Graham Company v. USI MidAtlantic & Haughey (E.D. Pa.). After two appeals to the Third Circuit and two (denied) petitions for cert., received affirmance of $30.4 million judgment based on jury award in copyright case claiming indirect profits under section 504(b) of the Copyright Act.

  • Yellow Pages Photos, Inc. v. Ziplocal LP and Yellow Pages Group, LLC (M.D. Fla.) Plaintiff obtained nominal jury award against our client where plaintiff was claiming $1.5 billion in damages. District court denied request for fees. Eleventh Circuit affirmed ruling on what constitutes a “work” for purposes of copyright statutory damages.

  • deCode v. Hakonarson et al. (E.D. Pa.). Obtained favorable settlement on behalf of The Children’s Hospital of Philadelphia and four scientists in trade secret/non-compete case.

  • US Office Products v. Allied Office Supplies Inc. et al. (D. Del.). Obtained preliminary injunction and $5.8 million settlement in corporate raid case involving theft of trade secrets on behalf of $1 billion office products company.
  • TruePosition v. Andrew Corp. (Del. Super. Ct.). Obtained high seven figure settlement in patent licensing dispute.

  • Nixon v. Commonwealth, 576 Pa. 385, 839 A.2d 277 (2003). Pro bono representation of rehabilitated ex-felons challenging constitutionality of employment ban; Supreme Court held ban unconstitutional.
