Keith M. St. Aubin practices in Duane Morris' Trial Practice Group. Mr. St. Aubin practices in federal and state courts in the areas of commercial, business, and construction litigation and has experience representing companies and individuals in cases involving products liability, commercial real estate and loan disputes, RICO, financial services, construction defect and delay, transportation, medical malpractice, breach of contract, fraud, and trust and estate disputes. He has also represented various healthcare and related organizations in courts and before administrative agencies, has drafted legislation on their behalf, and has testified on multiple occasions before Illinois House of Representatives’ subcommittees in support of such legislation. Additionally, Mr. St. Aubin has been involved in multiple construction-related claims on behalf of general contractors and consultants in the international arbitration context. 

Mr. St. Aubin is a 2016 cum laude graduate of the University of Illinois College of Law, where he was editor-in-chief of the Illinois Business Law Journal, and a graduate of Fordham University.

Representative Matters

  • Secured defense verdict at trial on behalf of private ambulance company’s agent against claim alleging willful and wanton misconduct related to operation of ambulance during non-emergency transport. Following trial, successfully defended against post-trial motion seeking to reconsider and vacate the judgment.

  • Represented Children’s Habilitation Center (CHC), a facility for medically complex and developmentally disabled children, in assisting to pass a bill to ensure that more efficient and straightforward funding mechanisms exist for the children who reside at CHC and similar facilities in Illinois.

  • Represented global retail pharmacy company in Illinois class action dispute against various consumer fraud and product liability claims and obtained dismissal with prejudice of all claims.

  • Represented national real estate development company in nationwide civil RICO action related to contracts-for-bribes schemes that resulted in multiple favorable settlements.

  • Obtained dismissal of lawsuit, striking of defendant’s motion for summary judgment, and award of full damages and attorneys’ fees and costs, as sanction for repeated discovery violations.
  • Represented a skilled pediatric facility providing long-term care for babies and young developmentally-disabled children, most of whom are on ventilators, in settling, on terms the client found highly favorable, a highly contested case against the Illinois Department of Public Health in which the Department sought to impose severe penalties against the facility in connection with a patient's death.

  • Secured temporary restraining order on behalf of physician involved in departure from former practice and, separately, obtained assignment of leased premises and secured all physician’s patient records held by former practice.
  • Obtained dismissal of plaintiff’s lawsuit against physician, which had falsely alleged childhood sexual abuse during their psychiatrist-patient relationship from over 25 years ago, and sanctions for filing in an improper venue; dismissal and sanctions affirmed on appeal in the 2nd District Appellate Court of Illinois.

  • Obtained dismissal of oral contract claim based on statute of frauds defense.

  • Secured nearly $5 million judgment on behalf of home for adults with developmental disabilities in trust dispute.
  • Member of team that secured $3.75 summary judgment victory stemming from asset purchase dispute involving multi-million dollar post-closing adjustment, including award of pre-judgment interest and attorneys’ fees and expenses.

  • Obtained dismissal on behalf of major U.S. brokerage firm in dispute in which plaintiff sought injunctive relief and monetary damages.

  • Sought and obtained injunctive relief on behalf of Chicago-area charter school.

  • Represented leading global transportation services provider in dispute with nominated trucker regarding extensive storage charges/fees, related insurance issues, and third-party collection company resulting in zero liability and nearly full reimbursement of fees.

  • Successfully drafted motions and argued for dismissal of various claims in Illinois State court based on the immunity afforded to private emergency medical transportation providers and their employees under the Illinois Emergency Medical Services (EMS) Systems Act.

  • Prosecuted multiple foreclosure claims on behalf of lenders resulting in summary judgments and subsequent foreclosure sales.

  • Secured favorable settlement on behalf of limited liability company member in member dispute over automotive parts company.

  • Represented real estate investment company in action alleging racial discrimination / retaliation, violation of the Cook County Landlord Tenant Ordinance and related claims, and ultimately settled all claims on very favorable terms for small fraction of alleged damages.
  • Counselled international healthcare company in pre-litigation dispute with customer over alleged products issues resulting in settlement.

  • Represented pro bono client in federal lawsuit brought pursuant to the Hague Abduction Convention and secured return of client’s children.

  • Represented incarcerated individual pro bono in U.S. District Court for the Southern District of Illinois on 8th Amendment claim and secured jury verdict in excess of $60,000 (with costs) after settlement offer refused.
