Monté T. Squire practices in the area of intellectual property law. Mr. Squire has experience with representing and advising national and international corporations and individual clients in all aspects of intellectual property and commercial litigation. He has extensive experience litigating cases in the District of Delaware across a broad range of complex technologies, including patent infringement cases involving computer software, Internet technology, biomedical devices, life sciences, pharmaceuticals, semiconductor technology, aeronautical equipment and mobile navigation technology. Mr. Squire is also experienced litigating commercial disputes in federal court, as well as advising clients and providing opinions on complex IP-related legal issues, including patentability, invalidity, infringement/non-infringement, and procedural issues specific to federal trial court practice, including the interplay between and considerations involving pending patent litigation in federal court and related parallel proceedings before the U.S. Patent and Trademark Office.

Prior to joining Duane Morris, Mr. Squire served as an Administrative Patent Judge and member of the Patent Trial and Appeal Board for the U.S. Patent and Trademark Office in Alexandria, Virginia, where he heard and presided over patent trial proceedings and appeals from patent application decisions involving cutting-edge inventions and emerging technologies as part of a three-judge panel that provided expedited patent trials and review of disputed matters concerning patent validity, including inter partes review (IPR) and related proceedings.

Mr. Squire is a 2005 cum laude graduate of Widener University School of Law, where he was a managing editor of the Delaware Journal of Corporate Law. He also is a graduate of Wilmington College (M.B.A., high honors, 1999) and the University of Delaware (Bachelors of Chemical Engineering, 1995). He also served as law clerk for Judge Gregory M. Sleet on the U.S. District Court for the District of Delaware.

Additionally, Mr. Squire is the past chair of the Delaware State Bar Association Multicultural Judges and Lawyers Section and past president of the Delaware Barristers Association (an affiliate of the National Bar Association), and currently serves as a member of the Lawyers Advisory Committee for the District of Delaware. Mr. Squire was also recently appointed by Chief Judge Colm Connolly to serve as one of the Special Masters for the U.S. District Court for the District of Delaware. He has also served as a board member for numerous nonprofit organizations throughout Delaware.

Representative Matters

  • Represented Unirac, Inc., a solar power infrastructure provider, in two patent cases against industry competitors ECOFasten Solar, LLC and Esdec Inc. in the District of Delaware; the court ruled in favor Unirac, Inc. on nearly all of the disputed claim construction terms and both parties were able to reach a settlement and a joint stipulation of dismissal.
