Shortly after President Trump first began to impose tariffs under purported authority of the International Emergency Economic Powers Act (“IEEPA”) on February 1, 2025, Duane Morris formed a Tariff Mitigation Task Force to assist clients in developing strategies to mitigate their potential tariff exposure. On February 20, 2026, the Supreme Court of the United States (“SCOTUS”) issued its long-awaited decision in Learning Resources, et. al, pursuant to which SCOTUS held that IEEPA does not authorize the President to impose tariffs. Shortly after the issuance of the decision in Learning Resources, et. al, President Trump announced that he plans to impose tariffs of 10 percent on all products imported into the United States pursuant to Section 122 of the Tariff Act of 1974 (“Section 122 Tariffs”). Duane Morris’ Tariff Mitigation Task Force is considering the implications of the SCOTUS Learning Resources, et al. decision and President Trump’s announcement relating to Section 122 Tariffs and plans to issue a detailed Client Alert in the very near future.
