Anthony J. Fitzpatrick is a partner in the firm’s Boston office and co-chair of Duane Morris’ Patent Litigation division. His practice focuses on patent, trade secret and other technology-related litigation. Fitzpatrick has extensive experience as lead counsel at trials in federal and state courts and in arbitration. He has also argued on multiple occasions before the Court of Appeals for the Federal Circuit and before the Patent Trial and Appeal Board of the USPTO. He has litigated matters involving diverse technologies and has gained particular experience in the life sciences, including pharmaceuticals, biologics, medical devices and diagnostics. Fitzpatrick frequently represents clients in disputes concerning the inventorship, ownership and licensing of patents. He has extensive experience in negotiating and drafting agreements to resolve complex intellectual property disputes, including agreements to resolve litigation under the Hatch-Waxman Act.
Thomas J. (Tom) Kowalski is a seasoned registered U.S. patent attorney, a partner in the firm’s New York office and a member of the firm’s Intellectual Property and Life Sciences groups. His practice includes biotechnology, chemical and medical apparatus litigation/contentious matters, patent prosecution, licensing, investor due diligence, and counseling with extensive experience in matters of personal and personalized medicine, genetics and genetic engineering (e.g., CRISPR, TALES/TALENS, zinc fingers, siRNA, RNAi), plant varieties and genetically modified plants, biological inventions arising from big data/data mining/AI (including from data from massively parallel sequencing, transcriptome analyses, single cell genomics, cell signatures and the various “Seq” tools, e.g., “DropSeq,” “RNASeq” and “PerturbSeq”), virology, immunology, antibodies, vaccinology, T-cell receptors, cell-based therapies such as tumor infiltrating lymphocytes, biologics, pharmaceuticals, medicinal chemistry, crystallography and small molecules, amongst other fields of biotechnology and chemistry. Kowalski also represents clients in procuring and enforcing trademarks and design patent rights. He obtains trademark and design patent protection domestically and worldwide, and he enforces trademark rights and defends clients accused of trademark infringement in the United States. Kowalski also actively works with clients on strategies to avoid litigation, clear out the IP underbrush that impedes passage through IP thickets, and maximize patent portfolios and investor funding.
Jonathan Lourie, a partner in the firm’s Boston office and a team lead for the Duane Morris Life Sciences and Medical Technologies Industry Group, represents companies, institutions and individuals working in life sciences and medical technologies around the world. His experience includes debt and equity financings including venture capital, complex licensing and collaborations, mergers and acquisitions as well other aspects of getting products to market such as CRO and CDMO, clinical trial and marketing and distributions agreements. Lourie has advised companies engaged in such areas as genomics, biologics, drug and drug discovery, medical devices and diagnostics. He is also a frequent speaker and writer in the area of life sciences.
Vicki G. Norton, a partner in the firm’s San Diego office, serves as a team lead for the Duane Morris Life Sciences and Medical Technologies Industry Group. In over two decades of life science patent counseling and litigation, she has devised strategies for clients to successfully counter patent claims and demands totaling more than $2 billion; has performed IP diligence for transactions and at-the-market offerings worth more than $2.5 billion; and has formulated worldwide patent strategies for clients entering public markets with valuations of more than $6 billion. Norton also audits technology portfolios and identifies patent coverage issues for her clients’ transactions, venture financings and patent enforcement opportunities. She has handled patent matters in a variety of life science fields, including precision medicine and diagnostics, biologic drugs, pharmaceuticals, immuno-oncology, stem cell technology, transgenic plants and cells, methods to screen and make gas-absorbing materials, molecular biology, nanotechnology, combinatorial chemistry, probe amplification assays, nutraceuticals, microbiology and devices for physical therapy. Norton has also advised clients on all facets of litigation involving technologies including diagnostics, biopharmaceuticals, transgenic organisms, small molecules and nanotechnology.
