Neville M. Bilimoria is managing partner of Duane Morris' Chicago office. He is a Chambers USA ranked healthcare law partner with Duane Morris LLP’s  Health Law Practice Group and the Cannabis Law Industry Group. Mr. Bilimoria advises health care clients on corporate and litigation matters and counsels hospitals, health systems, nursing homes, assisted living facilities, physicians, physician groups, pharmacies and pharmaceutical companies on a variety of issues, including health care corporate transactions, healthcare fraud and abuse, compliance issues, telemedicine and telehealth, HIPAA and state health privacy law issues, regulatory compliance, and resulting litigation. Mr. Bilimoria is the chair of Duane Morris’ Physician Services Group nationally and the Telehealth Group nationally.  Mr. Bilimoria is listed in Chambers USA: America’s Leading Lawyers for Business, 2019-2023 editions.

Mr. Bilimoria's corporate work includes representation of clients in transactions for the purchase and sale of healthcare facilities, health clinics and physician practices, as well as counseling on various healthcare contracting issues. He has represented healthcare providers in administrative law matters and disciplinary actions. He has counseled pharmaceutical companies and pharmacies on state and federal regulatory issues. Mr. Bilimoria is a member of the firm’s multidisciplinary AI group, advising clients on emerging technologies.

Mr. Bilimoria was named one of the Top 40 Attorneys in Illinois Under 40 for 2005 (out of a pool of almost 60,000 eligible attorneys). He has also been listed by Illinois Super Lawyers since 2009 in Healthcare Law. He has been listed by the Illinois Leading Lawyers Network in Health Care Law since 2010. 

A frequent author and speaker on healthcare topics, he is the past Chair of the Chicago Bar Association's Health Law Committee. Mr. Bilimoria was also a Professor for Rush University Medical Center’s Graduate Program in Health Systems Management. 

Mr. Bilimoria is a member of the American, Illinois State and Chicago bar associations, the American Health Lawyers Association and the Illinois Association of Healthcare Attorneys. He earned a B.A. in Philosophy from Northwestern University, where he received a Kappa Alpha Pi Award for academics and leadership. He received a J.D. from Northwestern University School of Law. He is also a former recipient of the India Tribune's Outstanding Youth Award and the North American Zoroastrian Outstanding Youth Award.

Representative Matters

  • Represented a nonprofit facility providing housing, amenities, and support services for intellectually and developmentally disabled adults in settling a resident negligence case on terms the client found extremely favorable. A resident had passed away from as of yet unknown causes while under the care of the facility, and the team managed the case through a yearlong Illinois State Police investigation and plaintiff lawsuit alleging wrongful death. The facility had a slipup in coverage through its broker, resulting in a complete loss of insurance coverage for the claim, but the team managed to secure broker’s insurance, which also covered legal fees and the settlement.

  • Represented Children’s Habilitation Center (CHC), a facility for medically complex and developmentally disabled children, in assisting to pass a bill to ensure that more efficient and straightforward funding mechanisms exist for the children who reside at CHC and similar facilities in Illinois. 

  • Developed strategy for reimbursement dispute on behalf of this 103 hospital system against managed care organizations. Worked with client to define avenues of claims against managed care organizations for abuses and breaches of contractual relationships with several client hospitals. Preparation for large arbitration action involving several hospitals against managed care organization. Ongoing negotiations continue with managed care organizations to collect monies owed to various hospitals.

  • Assisted a nursing home in defending various government surveys and other deficiencies resulting in fines and civil money penalties. Financial hardship was granted resulting in avoidance of over $80,000 in fines and penalties. Provided counselling to clients to help facility avoid government fines and penalties, negotiated a payment plan to pay them, and obtained significant reductions in fines and penalties.

  • Assisted group of nursing homes in defending various government surveys, including COVID-19 surveys, and other deficiencies resulting in hundreds of thousands of dollars in fines and civil money penalties against each nursing home. Provided counselling to clients regarding various resident incidents to help facilities avoid up to hundreds of thousands of dollars in fines and penalties from the government. Negotiated a payment plan to pay fines and penalties, in addition to obtaining significant reductions of them.

  • Assisted supportive living facility (SLF) in deciphering detailed application from the Illinois Department of Healthcare & Family Services (IDHFS) for certification/licensure of additional SLF beds. Advised regarding application process, drafting of application, interpretation of intervening legislation, and advice regarding buildout and construction regarding additional SLF beds for dementia care.
  • Assisted pharmacy owner to prevent unlawful termination of pharmacy contract by nursing home client. Worked with client to develop emergency strategy, including preparation and filing of temporary restraining order preventing termination under contract terms. Achievement of successful settlement which allowed pharmacy to continue lucrative relationship with facility as client of pharmacy as a result of our filing and negotiation.

  • Assisted a large physician group with compliance issues regarding health care fraud and abuse regulations. Prepared and finalized Office of Inspector General (“OIG”) Voluntary Self-Disclosure on behalf of client regarding overpayment issues for disqualified employee. Worked with client to assemble and file pursuant to OIG Voluntary Self-Disclosure Protocol.

  • Represented a skilled pediatric facility providing long-term care for babies and young developmentally-disabled children, most of whom are on ventilators, in settling, on terms the client found highly favorable, a highly contested case against the Illinois Department of Public Health in which the Department sought to impose severe penalties against them in connection with a patient's death.

  • Won an appeal in the 2nd District Appellate Court of Illinois on behalf of a physician; the Court affirmed the dismissal of plaintiff’s lawsuit against the client, which had falsely alleged childhood sexual abuse during their psychiatrist-patient relationship from over 25 years ago. 

  • Counsel to a privately-owned and operated company offering health care and senior living options, on complex CARES Act Provider Relief Fund compliance issues concerning use of COVID-19 funding for this group of skilled nursing facilities.

  • Represented a skilled nursing facility against the Illinois Department of Public Health and Centers for Medicare and Medicaid Services (“CMS”) for surveys involving resident injury and large Civil Monetary Penalty (“CMP”).

  • Assisted the operator of a prestigious and award winning skilled nursing facility in purchasing the real estate of the facility from the 20 year property owner pursuant to a complex lease and purchase agreement.

  • Assisted a sophisticated cannabis facilities operator to file 12 applications for cannabis dispensary licenses over the new year with extremely complicated dispensary applications in Illinois.

  • Assisted a plastic surgeon to develop a strategy, provide concerted advice, and execute on a complicated divorce of his practice from a toxic medical practice at an academic medical center.

  • Defending a physician against plaintiff allegations of abuse from a former patient.

  • Assisted a worldwide software licensing platform on its move to telehealth services amidst pandemic and counselled the client on health care regulatory issues and HIPAA Privacy issues to assist in formulating a nationwide strategy for product development, structure and rollout.

  • Assisted a charter franchise of the National Football League on various matters concerning the COVID-19 pandemic and COVID-19 laboratory testing and counselled them on various HIPAA privacy issues, and state privacy issues, as well as informed consent issues with regard to COVID-19 testing and protocols.

  • Assisted a senior care operator in various corporate strategies and advice concerning two large plaintiff malpractice lawsuits against two assisted living facilities owned by the client.

  • Successfully closed a complicated $30 million purchase of more than a dozen assisted living facilities, together with appropriate licensure applications and approvals, on behalf of a senior living provider.

  • Represented Meadows Mennonite Retirement Community in salvaging two large nursing home communities in Illinois by selling a distressed assisted living facility saddled with debt.

  • Represented a nonprofit skilled nursing facility under severe financial distress, and its Board of Directors, in its sale to a nursing and rehabilitation center. The deal kept the facility in business under a new owner, providing needed services and jobs in the rural community.

  • Represented the Refac Optical Group, a leading provider of vision care products and services, in the sale of one of its subsidiaries, Nationwide Optical Group, Inc., to Clarkson EyeCare Partners, Inc.

  • Successfully negotiated the dismissal of the affirmative healthcare fraud allegations and obtained a sentence of probation on behalf of a physician accused of accepting kickbacks in U.S. v. Tolentino, et al. despite both the US Attorney's Office and Sentencing Guidelines both recommending a substantial prison sentence. More importantly, obtained the affirmative recommendation of the federal court that the physician be allowed to maintain his license to practice medicine, despite the conviction for health care fraud.
  • Represented a senior residential care corporation as health regulatory counsel in a $230 million transaction in which the client sold assisted living properties in five states to a REIT.

  • Conducted detailed contract reviews and drafting of pharmacy benefit manager (PBM) contracts for pharmacies nationwide, including review and drafting of Medicare Part D Prescription Drug Program agreements and requirements.

  • Conducted review of hospital federal research grants and developed report on research grant administration, funding, and federal research grant compliance.

  • Represented a major life sciences company in detailed contract reviews concerning major pharmaceutical distribution agreements, in healthcare law compliance issues, and provided guidance on contract negotiations. Additionally, we advised the company on various HIPAA compliance issues and real estate lease matters.

  • Represented nursing home in its relocation before the Health Facilities Planning Board on Certificate of Need matters and successfully gained approval for the multi-million dollar project.

  • Representing hospital in its corporate compliance, antitrust compliance, and its response to FTC subpoenas for antitrust suit against another hospital.

  • Represent physician group in revenue recoupment matter against major private payor to assist group in recouping monies owed and renegotiating provider contract with payor.

  • Counsel to nursing homes, hospitals, and pharmaceutical companies on health care fraud and abuse issues, including implementation of corporate compliance plans and HIPAA compliance plans.

  • Counsel to all types of health care providers in the drafting and reviewing of contracts.

  • Counsel to a hospital health system in a review of its health care fraud and abuse compliance program.

  • Counsel to nursing facilities in administrative litigation matters before CMS and IDPH.

  • Counsel to healthcare professionals before state disciplinary agencies.

  • Counsel to Illinois pharmacies in federal court regarding the Illinois Department of Public Aid's Medicaid reimbursement reduction for drugs and pharmacy services.
