Education Technology (EdTech) is a rapidly expanding, but highly specialized and regulated sector of the education industry. Just as market forces came together to combine technology with education to meet market needs, the legal intersection between intellectual property, education, and privacy and data protection laws has created a great need for highly specialized EdTech legal practitioners. Understanding and navigating these legal issues is key to success in the EdTech space. Duane Morris’ multi-disciplinary EdTech team was formed to capture our capabilities and experiences through an industry-focused lens. And, because the EdTech sector is focused on using technology to meet the needs of the education industry, our industry leading IP practice is an important component of our EdTech Team. Our EdTech Team is primarily focused in the following areas with respect to the education technology sector:
- Transactional: Mergers and acquisitions, lending and finance, capital markets, funding and investment opportunities.
- Education Regulation and Compliance: Requirements of the U.S. Department of Education (USDE), accreditors, and state licensing agencies along the following learning continuum: (1) Early childhood education (ECE); (2) K-12; (3) higher education; and (4) lifelong learning and corporate training.
- IP: Patent, trademark, copyright, trade secret and other technology disputes and litigation, enforcement and defense, alternative dispute resolution, licensing opportunities and strategies, and patent and trademark prosecution.
- Privacy and Data Security: Website disclosures, FAQs, terms of use, privacy policies and e-signatures, cybersecurity, and privacy and data concerns.
